• NCEU Wins Arbitration Suspension Overturned

    The NCEU wins an arbitration for an officer from York County Maine that was considered to be sleeping by a coworker and subsequently management. The Officer received a three (3) day suspension for sleeping/being inattentive to her duties on two (2) occasions based on her fellow officers report and a video that was produced by the captain of operations. The York County Commissioners upheld the discipline imposed by the Captain, so the NCEU filed the matter to arbitration for lack of just cause. Arbitrator Robert Crowley found in favor of the NCEU's evidence and testimony that the officer was not sleeping. However, the arbitrator felt the member was inattentive to her duties for a minute or two due to extenuating circumstances so the three (3) day suspension was reduced to a written warning.
