Q. If I sign a decertification card/sheet, does that mean I will automatically be represented by the NCEU? A. No, it merely means that you and your fellow members/employees are showing interest in a union other than your current representative. After the 50% +1 of the signatures of the total union body are submitted to the Division of Labor, an election will be held within 1-5 months. On the ballot will be the NCEU, your current representative, and no union.
Q. During the 1-5 month time frame, am I covered by my contract and current representative? A. Yes, your current contract will remain in full force and effect until a successor agreement is reached with your employer. Your current organization is responsible to represent you. In the event your current organization does not represent you, the Law Offices of Moriarty and Connor made a committment to the NCEU that they will represent you at no cost.
Q. My current schedule is a 4+2, and I am being told that the Sheriff can change my schedule without negotiating because a new union represents me. Is this true? A. No, it is not true. This is a prime example of your current representative using a scare tactic to confuse and intimidate their employees. The only way your schedule would change is thru contract negotiations, and the parties reach a successor agreement that is ratified by your entire union body. Remember, your current contract stays in full force and effect until a new agreement is reached.
Q. What happens to the current Executive Board of my Local? A. The NCEU may call for Local elections. The local leadership will always be determined by the membership of each Local. (i.e., elect a new board or keep the existing board)
Q. What happens to the grievances and arbitrations that have been filed by my current representative? A. The grievances and arbitrations change hands to the NCEU. They do not get dismissed because you have changed representatives. Your current representative is responsible to ensure that all of the information and files are passed on to the NCEU. Q. Will I lose my dental and optical benefits? A. If the benefits are provided to you by your current union representative, then you will lose them upon the certification of the NCEU. The NCEU Health and Welfare Fund will then provide you with optical and dental benefits after brief negotiations with your employer. It is important to note that there will not be a period of time that you are without the benefits. In the event the benefits are provided by your employer, then you will not lose your benefits.
